We've been discussing this here for a couple years now. At least since the case of the motorcyclist in Maryland that filmed the off-duty cop yelling at him. The problem is these laws made sense when they were enacted, but now that everyone carries a recording device they need revision. Every American citizen expects to be able to record public figures, but nobody wants to be recorded themselves.
