OUTCOME: No action taken. Assistant Prosecuting Attorney said she does not have a license to practice in Maryland, but will soon provide legal recommendations that apply to this jurisdiction.
2. Motion to Support Flowing Springs WWTP Only, And If Done Only by Builder W/O Criminal Record
OUTCOME: Agenda Item stricken at the outset of the meeting on a motion of Commissioner Manuel and by 4 to 1 vote (along with Items 3 and 4 herein). It was thus impossible to discuss.
Commissioners Tabb, Corliss and Manuel voted to endorse the construction of two waste water treatment plants costing between $34 and $40 million for both.
Surkamp and Morgan voted against, supporting just one.

NOTE: I would have proposed sending a letter to the Secretary of the Interior concerning a recent laying of sewer pipes across federally owned lands in Harpers Ferry called the Perry Orchard. The letter would have requested that if these actions were found illegal by the Department's Solicitor, then the County asked the pipes be removed by the responsible parties at their expense.

OUTCOME: Motion made. No second given. Discussion was unfortunately aborted by vocalized perception of other Commissioners that the motion impugned the performance of a staff attorney. I praised the attorney in question and stated this was a needed procedure change, requested by several members of the BZA.
