I have a few questions about being "pulled over" (more on that later) by a deputy for "reckless driving" on 81. The deputy was driving a pickup truck and riding my ass for more than a mile and then followed me off of the interstate and into the parking lot of my employer. He sort of scared me a bit because I had no idea that this big pickup truck (like a F350 or something) was a cop car until I could see it from the side and saw that it said sheriffs dept on it. But no lights and no uniform (he was wearing a sweatshirt).

He tapped on my window and showed his badge and asked me if there was something wrong with my speedometer. Well, actually, yes there is something wrong with it. It works but is about 8 mph off. He said that he was citing me for 'reckless driving' and 'defective equipment.' He then said that his lights and siren "must have blown a fuse" and that he also didn't have a citation book with him so there would be a warrant issued for my arrest later in the day. Of course this terrified me and I asked him more about that and he said that he would give me a call "as a courtesy" and took down my phone number.

I really don't think that I was driving 'recklessly' - I was likely speeding but he didn't mention that. I was in one lane the whole way -- wasn't swerving in and out of traffic or riding close to other cars. In fact, I was probably shifting lanes before I got off of the highway because the intimidating pickup truck was riding my ass for more than a mile and I pulled into another lane because of that. I had no idea that it was a cop.

Please don't say things like "well you shouldn't speed" or something. I know. I shouldn't. I have asked a mechanic about my speedometer before and have been told that it isn't worth it and I would basically need to just get a new car because of the expense.

Any thoughts on how I might challenge this? I really don't feel that I was "reckless". He also misstated how many points it would be on my record. He told me it would be 3 but the DOT website says that it is 6! I don't want 6 points! I haven't ever dealt with a ticket in WV - currently have no points. How does this play out? Any tips? I'll pay a fine if I need to and take a few points if it is warranted but 6!?! I sort of think that he wasn't able to clock my speed and knew I was speeding so went with the "reckless driving" thing.

Thoughts? How do you deal with this is WV?

Thanks in advance!
