There were 4 kids in that SUV and none were wearing seatbelts, nor the driver or other adult passenger. I hope they all recover.

The sad part, is, I see kids in cars unbuckled ALL the time.
And kids that should still be in car seats not even buckled with a regular belt.
I don't know if these parents are DUMB or if they just don't care if their kids die.
I hope those kids are all going to be ok.

The little girl is in Childrens Hospital in DC She has numerous Surgeries and will most likely come home on Friday.
The mother is stillin the hospital in Fairfax. and is getting better.
The other children are fine.
as far as the man he is jail.

Sounds like that both Jackie Hebb and Bridgette Rothen are a couple of real prizes. She was drinking and driving too by her own statement and she didn't bother belting her kids in either. IMHO, she should be charged right along with him.
And it's because of stories like this that I never--ever--pass up an opportunity to stop any driver with unrestrained kids and write the appropriate tickets. Got one last year who had four unrestrained kids and he got four tickets @ $135.00 each. (plus one for him not wearing a seatbelt.)

If she wasn't under arrest, there's no requirement that she have an attorney, Matlock.Miranda rights only attach when a subject is in custody. And there's no legal exception that presumes that an injured person's statements are unreliable due to pain.
The reason that she wasn't charged is more likely because an officer did not see her driving or otherwise in control of the vehicle (a requirement for a DUI conviction) and I would also surmise that she was not forced to submit to a breath or blood test.
But she can be charged with other crimes I would think, child neglect or endangerment being but one. And even if she's not charged criminally, she should now be on social services' radar for a while.

Have you ever noticed that those who advocate the hardest for personal responsibility never seem to take any when they cause their own negative situations?
But a blood-alcohol level over 0.08% is required for a DWI conviction, and without a test, here mere admission that she'd been drinking isn't enough to establish that her BAC was above that magic number. Likewise for the lesser-included DUI. A BAC is needed or lab test showing drugs in the system is needed for a conviction.
In a case like this, the Sheriff's office could subpeona hospital blood test results and use an expert in alcohol metabolism to show what the BAC would have been an hour and two hours prior, but it takes a lot of work to make a case that way and frankly I would not want to put a technical case like that before a WV jury just to get a conviction in a state that really doesn't punish DUI drivers in the first place.
Now in Virginia--especially with kids hurt--that case might go. But probably not here.
I think it is awesome that you ticket people with unrestrained kids. I would not last a day on your job without choking the crap out of someone. I don't even know how I do my job sometimes, but I am sure you have seen your share of far worse. Yay Nanuk!![]()

What city said made me think of it...
My dad was in a really bad accident once, rolled his ford ranger over a good 5 or 6 times...He went into the windshield pushed it out with his head (body attached) slid across it and then flew out the passenger side (rolled up) window. (This is before seatbelts were law in ME. Thankfully they weren't or he'd most likely be dead - as the cab was completely crushed.)
Annnyyyhow...
When he was being treated on the side of the road the paramedics and cops and what-not asked him if he was the only one in the truck, for whatever reason he thought his cousin had been with him. He told them, "no, my cousin was with me." So they all went out searching and searching for another body. Only, found nothing, came back however long later and asked him again, his answer this time, "no, no one was with me it was just me." So they searched again for the heck of it!
I wish I had the pictures of his face after that accident, I would love to scan them in so you all could see. It was right at Halloween time and people that came to the door told him he has one heck of a costume!!!
Back to the rere's - I hope the mom is charged. I don't care how drunk I am, I always remember to buckle my kids!
